These Terms of Service govern your use of RetouchResistance.com, a website owned and operated by Song Spark LLC. The website allows eligible users to create an account and obtain licensed access to digital story content ("Entries") for use with the Retouch Reality reader application.
RetouchResistance.com and the Retouch Reality experience are works of fiction created for entertainment. The story, Entries, artwork, interface elements, and related materials intentionally contain fictional technology, fictional warnings, fictional system messages, and impossible claims as part of an immersive narrative. The fictional application known as 'Retouch' may claim to alter reality, permanently change a person's appearance, influence memories, or perform other impossible acts. These claims are fictional narrative elements only and are not descriptions of the real-world capabilities of the website or the Retouch Reality application.
You must be at least 13 years old to create an account or obtain access to Entries.
Your name and email address are collected during account creation. You are responsible for maintaining accurate account information and safeguarding your login credentials. Purchased Entry access is associated with the account email used when the purchase is made.
Entries are purchased through this website only. Payments are processed securely by Stripe. Song Spark LLC does not store complete payment card information. Purchasing an Entry grants your account a personal, non-transferable license to access that Entry within the Retouch Reality reader application. Purchases do not transfer ownership of the literary work or any intellectual property.
Unless required by applicable law, purchases of digital Entries are generally non-refundable because access is provided promptly after purchase. Song Spark LLC may issue refunds for duplicate purchases, billing errors, technical issues preventing access, or other exceptional circumstances at its discretion.
The website, software, branding, graphics, and website content are owned by Song Spark LLC. The story, Entries, dialogue, characters, artwork created for the narrative, and literary content are the intellectual property of Andrea Guillien and may not be copied, reproduced, redistributed, adapted, or commercially exploited without prior written permission.
Your email address is collected only during account creation. It may be used for account management, receipts, purchase confirmations, important account or security notices, and optional notifications when new Entries become available. New Entry notification emails may be turned off from your Retouch Reality application settings or by deleting your account. Essential transactional, legal, or security communications may still be sent when necessary.
You may not use fraudulent payment methods, attempt unauthorized access, interfere with website security, infringe another person's intellectual property rights, violate applicable law, or misuse the website or its services.
The website and digital content are provided 'AS IS' and 'AS AVAILABLE' to the fullest extent permitted by law.
To the fullest extent permitted by law, Song Spark LLC shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the website, payment interruptions, third-party services, or inability to access purchased Entries due to circumstances beyond its reasonable control.
Song Spark LLC may update these Terms from time to time. Continued use of the website after changes become effective constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Connecticut.
